NakSeat Affiliate Terms & Conditions

1. About the NakSeat Affiliate Program

The NakSeat Affiliate Program lets approved partners refer businesses to NakSeat and earn a commission when those businesses pay for a NakSeat subscription. NakSeat is operated by NAS Puncak Alam Resources. By applying to the program you agree to these terms.

2. Eligibility

You must be at least 18 years old and hold a valid NakSeat account. You must provide accurate personal or business details. NakSeat may ask for verification at any time.

3. Approval and rejection

Applications are reviewed manually. NakSeat may approve or reject any application at its own discretion and is not required to give a reason. You cannot earn commission until your application is approved.

4. Referral attribution

Each approved affiliate receives a unique referral link. A visitor who arrives through your link is remembered in their browser for 30 days. Attribution is written once, at the moment the referred business creates its Merchant account, and cannot be changed afterwards. If a Merchant is already attributed to another affiliate, no new attribution is created. Attribution can fail if the visitor blocks cookies, clears their browser, or signs up on a different device.

5. Commission rate

Your commission rate is shown in your affiliate dashboard. When your application is approved, NakSeat assigns the default affiliate commission rate that applies at that time, and that rate is saved to your account.

NakSeat may change the default rate for future affiliates at any time. A change to the default does not change your rate. NakSeat may also change your individual rate. A rate change applies only to qualifying payments made after the change; commissions already recorded keep the rate that applied when they were earned.

6. How commission is calculated

Commission is earned only on successful NakSeat subscription payments made by Merchants you referred, and is calculated on the amount NakSeat actually collected for that payment.

If a Merchant uses a discount or voucher, commission is calculated on the discounted amount actually paid. Later renewals at the full price earn commission on the full amount paid.

Commission is recurring: every successful subscription payment from a referred Merchant earns commission for as long as the referral and your affiliate account remain in good standing.

No commission is earned on failed payments, unpaid or cancelled invoices, abandoned checkouts, event ticket sales, buyer payments, or any money that is not a NakSeat subscription payment.

7. Refunds and reversals

If a subscription payment is refunded or charged back, the related commission is reversed. Commission already paid out to you may be deducted from future commission.

8. Commission statuses

1. Pending. Recorded from a successful payment and awaiting review. 2. Approved. Reviewed by NakSeat and eligible for payout. 3. Paid. Included in a completed payout. 4. Reversed. Cancelled after a refund, chargeback or confirmed abuse.

9. Payouts

Payouts are processed manually by NakSeat. Only approved commission is eligible. Payouts are made by bank transfer to a Malaysian bank account unless NakSeat agrees to another method in writing.

You are responsible for providing and maintaining correct payout details, including bank name, account holder name and account number. NakSeat cannot process a payout while these details are missing or incorrect, and is not responsible for money sent to an account you entered incorrectly.

If NakSeat sets a minimum payout amount, commission below that amount stays approved and is carried forward to a later payout.

10. Self referral and prohibited conduct

You may not refer yourself, your own accounts, or accounts you control. Self referrals are flagged and earn no commission.

The following are prohibited and may lead to reversal of commission and termination:

1. Fraudulent, artificial or manipulated referrals. 2. Creating accounts on behalf of businesses without their knowledge. 3. Misleading claims about NakSeat pricing, features or performance. 4. Spam, unsolicited bulk messaging, or advertising that breaches any law or platform rule. 5. Bidding on or using NakSeat brand names in a way that misleads people about who they are dealing with. 6. Presenting yourself as NakSeat staff, or entering into any agreement on behalf of NakSeat.

11. No authority to represent NakSeat

You are an independent partner. Nothing in these terms creates an employment, agency, partnership or joint venture relationship. You have no authority to bind NakSeat or to make promises on its behalf.

12. Suspension and termination

Either side may end this arrangement at any time. NakSeat may suspend or terminate an affiliate account for breach of these terms, suspected fraud, or any conduct that harms NakSeat or its customers.

On suspension or termination:

1. Approved commission that was earned legitimately before the decision remains payable. 2. Pending commission is reviewed before any payment. 3. Commission linked to fraud or breach may be reversed and withheld. 4. No further commission is earned after the account is closed.

13. Tax

You are responsible for declaring and paying any tax due on commission you receive, including income tax and any applicable indirect tax. Where the law requires it, NakSeat may withhold amounts or request tax details before payout.

14. Changes to these terms

NakSeat may update these Affiliate Terms. Each update is published as a new version with its own version number and date. Where a change is material, NakSeat may require existing affiliates to accept the new version before continuing in the program. Commission and payouts already earned are not affected by a later version.

15. Limitation of liability

NakSeat provides the affiliate program as it is. To the extent permitted by law, NakSeat is not liable for indirect or consequential loss, lost profits, or loss arising from tracking failures caused by browsers, devices or third party tools. NakSeat total liability to you is limited to the commission properly payable to you.

16. Governing law

These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction over any dispute.
